Tobacco and Vapes Act 2026 Explained: What Changes for Adult Vapers

The Tobacco and Vapes Act 2026 is the biggest change to UK nicotine law in years, and its first measures took effect on 29 October 2026. From that date it is illegal to sell any vaping product or nicotine product to anyone under 18, including nicotine-free vapes and nicotine pouches, and it is an offence for an adult to buy them on behalf of someone under 18. Free samples and promotional giveaways have gone too. If you are an adult who buys pod vape kits, e-liquids or pouches, most of your shopping stays the same, but a few things around age checks, offers and future advertising are changing.
This guide separates what is already law from what is still planned. It covers the dates that matter, which products are affected, what the new offences mean for buyers, and the rules that were already in place before the Act, such as the 2ml tank limit and the new Vaping Products Duty.
Quick Answer
Since 29 October 2026, the Tobacco and Vapes Act 2026 makes 18 the minimum age of sale for every vaping and nicotine product in the UK, creates an offence of buying them for under-18s, and bans free samples and substantial promotional discounts. Adults can still buy legal vapes, e-liquids and pouches as normal.
- In force now: 18+ age of sale for all vapes (with or without nicotine) and nicotine products such as pouches, a proxy-purchasing offence, a ban on free distribution and substantial discounts, and a ban on vending machine sales.
- From 1 January 2027: tobacco cannot be sold to anyone born on or after 1 January 2009. This applies to tobacco, herbal smoking products and cigarette papers, not to vapes.
- Planned, not yet in force: a ban on advertising and sponsorship of vapes and nicotine products, intended from 1 June 2027, plus retail licensing and possible rules on vape flavours, packaging and display.
- Unchanged: 2ml tanks and pods, 10ml refill bottles, 20mg/ml maximum nicotine, and the single-use vape ban from 1 June 2025.
What Is the Tobacco and Vapes Act 2026?
The Tobacco and Vapes Act 2026 is UK-wide legislation that received Royal Assent on 29 April 2026. It does two big jobs. First, it creates the so-called smoke-free generation by permanently raising the age of sale for tobacco for anyone born on or after 1 January 2009. Second, it gives government much wider powers over vapes and nicotine products, from who can buy them to how they are advertised, packaged and displayed.
The Act does not switch everything on at once. Different sections start on different dates, and some parts only give ministers the power to make regulations later. That is why you will see some news stories describe things as "banned" that are actually still at consultation stage. The sections below follow the official dates set out on GOV.UK.
What Changed on 29 October 2026?
The first set of measures is now live across the UK. The table below summarises them, based on the government's guidance on selling vaping and nicotine products.
| Measure | What it covers | Start date | Status |
|---|---|---|---|
| Age of sale 18 | All vaping products (nicotine and nicotine-free) and all nicotine products, including pouches | 29 Oct 2026 | In force |
| Proxy purchasing offence | Adults buying, or trying to buy, these products for someone under 18 | 29 Oct 2026 | In force |
| Free distribution ban | Free samples, giveaways and free coupons that promote the products | 29 Oct 2026 | In force |
| Substantial discount ban | Selling at a nominal price to promote a product (normal discounts unaffected) | 29 Oct 2026 | In force |
| Vending machine ban | Sales of vapes and nicotine products from vending machines | 29 Oct 2026 | In force |
Age of sale is now 18 for every vape and nicotine product
Before the Act, the age-of-sale rule in England, Wales and Northern Ireland only covered vapes that contained nicotine. Nicotine-free vapes and products such as nicotine pouches had no legal minimum age in law. That gap has now closed. It is an offence to sell any vaping product or nicotine product to anyone under 18, in a shop or online. This includes zero nicotine vapes, nicotine pouches, nicotine strips and similar products.
Scotland already restricted both nicotine and nicotine-free vapes to over-18s. From 29 October 2026, nicotine products such as pouches are added there too, and Scottish retailers must extend their age verification policy to cover them.
Buying for under-18s is now a specific offence
Anyone aged 18 or over who buys, or tries to buy, a vaping or nicotine product for someone under 18 commits an offence. Retail staff are expected to refuse a sale if they suspect a proxy purchase. For adult buyers, the practical point is simple: only buy for yourself or another adult.
No more free samples or nominal-price offers
Giving away vaping or nicotine products, or coupons for them, is now an offence where the purpose or effect is to promote them. Selling them at a substantial discount for the same reason is also banned. GOV.UK gives the example that selling for a nominal sum such as 10p would likely be an offence. Ordinary price reductions, clearance of unsold stock, and bulk or trade pricing are not affected, so you may still see normal multi-buy deals and sale prices.
Penalties for retailers
Trading Standards can issue a £200 fixed penalty notice in England, Wales and Scotland for underage sales, proxy purchases, free distribution and substantial discounts. In Northern Ireland the proposed figure is £250, subject to Assembly approval. Prosecution can lead to much larger fines, and repeat offenders can be barred from selling these products for a period.
What Happens on 1 January 2027?
On 1 January 2027 the smoke-free generation measure begins. It becomes an offence to sell tobacco products, herbal smoking products or cigarette papers to anyone born on or after 1 January 2009. The test is the buyer's date of birth rather than their age, so this group will never be able to buy tobacco legally in the UK.
This rule does not apply to vapes, e-liquids or nicotine pouches. For those products the age of sale stays at 18. Shops selling tobacco in England will also need a new A3 notice stating that it is illegal to sell tobacco to anyone born on or after 1 January 2009.
What Is Planned but Not Yet in Force?
Several parts of the Act give powers that have not been used yet. These are worth knowing about because they could change how vapes are sold and presented over the next year.
Advertising and sponsorship ban, intended for 1 June 2027
The Department of Health and Social Care has said it intends to introduce a comprehensive ban on advertising and sponsorship of vapes and nicotine products across the UK from 1 June 2027, as set out on the government's health media blog. The detailed secondary legislation is still being prepared, so the date is a target rather than a law in force. According to that announcement, retail websites will still be able to share factual information about the products they sell, while content designed to encourage purchases may fall under the restrictions.
Many forms of vape advertising are already restricted today under the Tobacco and Related Products Regulations 2016, including TV, radio, newspapers, magazines and most paid online advertising. The new ban would extend restrictions to places such as billboards and shop windows, and would cover nicotine pouches for the first time.
Retail licensing and registration
The Act allows a licensing scheme for retailers of tobacco, vapes and nicotine products in England and Wales, but no start date has been set. Scotland's existing register is being extended to nicotine product businesses, with the offence of trading unregistered starting on 29 April 2027. Northern Ireland's register has been extended to vape and nicotine businesses, and councils there can issue fixed penalties to unregistered businesses from 1 March 2027.
Flavours, packaging and display
A UK-wide consultation on vape packaging, device appearance, flavour descriptions and in-store display closed on 2 October 2026. It included proposals such as plainer packaging and limits on flavour names. These are proposals only. No new rules on flavours or packaging have been made, so the flavours you can buy today are unaffected for now.
Rules That Were Already in Place
The Act sits on top of existing UK vape law. These rules have not changed, and they remain the basis for every product sold legally in the UK.
| Rule | Detail | Since |
|---|---|---|
| Tank and pod capacity | Maximum 2ml for nicotine-containing tanks and pods | 2016 (TRPR) |
| Refill bottle size | Maximum 10ml for nicotine e-liquid | 2016 (TRPR) |
| Nicotine strength | Maximum 20mg/ml | 2016 (TRPR) |
| Single-use vape ban | Vapes that cannot be recharged and refilled or re-podded cannot be sold | 1 Jun 2025 |
| Vaping Products Duty | £2.20 per 10ml of vaping liquid, with or without nicotine | 1 Oct 2026 |
| Duty stamps | All vaping products on sale must carry a duty stamp | From 1 Apr 2027 |
The single-use ban is why the market has moved to rechargeable devices with replaceable pods. If you are still choosing between formats, our guide to long-lasting alternatives after the 2025 ban explains the options. Product rules are summarised in the government's e-cigarette regulations guidance.
What the Act Means When You Buy Online
For adult customers, the day-to-day effect of the October changes is modest, but it helps to know what to expect.
- Age checks are standard. Online retailers must take steps to make sure they are not selling to under-18s. Government regulations setting out specific verification steps for England, Wales and Northern Ireland are still to be debated, so methods can vary between shops.
- Pouches are now age-restricted by law. If you buy nicotine pouches, the same 18+ rule now applies as for vapes.
- No free samples. You should not expect free flavour samples, free devices or free coupons with orders. Normal discounts and multi-buy pricing can continue.
- Buy only for adults. Ordering for someone under 18 is now an offence for the adult buyer, not just the seller.
- Check you are buying compliant products. Legal kits use 2ml pods or tanks, and nicotine e-liquids such as nic salts come in 10ml bottles at up to 20mg/ml.
Which Products Are Affected?
Every product category on a UK vape shop is now covered by the 18+ rule. That includes:
- Rechargeable refillable pods and the devices they fit.
- Prefilled refill pods and prefilled pod kits.
- E-liquids of every type, including nic salts, freebase liquids, shortfills and nicotine shots.
- Nicotine-free vapes and liquids.
- Nicotine pouches and other non-tobacco nicotine products.
Nicotine replacement products licensed as medicines, such as patches and gum, are regulated separately and are outside the scope of these age-of-sale changes.
Which Changes Should You Watch?
- The advertising ban timetable. Watch for the regulations that confirm the 1 June 2027 date. It may change how product information appears online.
- Flavour and packaging rules. The government's response to the consultation will show whether flavour names or packaging designs will change.
- Duty stamps. From 1 April 2027, every vaping product on sale must carry a duty stamp, so packaging will look slightly different.
- Retail licensing. A licensing start date for England and Wales would affect which retailers can sell vapes.
Frequently Asked Questions
When did the Tobacco and Vapes Act come into force?
The Act received Royal Assent on 29 April 2026, but its measures start on different dates. The age-of-sale, proxy-purchasing, free distribution and vending machine measures for vapes and nicotine products took effect on 29 October 2026. The tobacco smoke-free generation rule starts on 1 January 2027.
Is it illegal to sell nicotine-free vapes to under-18s now?
Yes. Since 29 October 2026 it is illegal across the UK to sell any vaping product to someone under 18, whether or not it contains nicotine. Previously, in England, Wales and Northern Ireland, the legal age limit only applied to nicotine vapes.
Are nicotine pouches 18+ in the UK?
Yes. From 29 October 2026, nicotine pouches and other nicotine products are covered by the 18+ age of sale across the UK. Before this date there was no legal minimum age for pouches in England, Wales or Northern Ireland.
What is a proxy purchase?
A proxy purchase is when an adult buys, or tries to buy, a vaping or nicotine product for someone under 18. It became an offence on 29 October 2026, and retail staff should refuse a sale if they suspect it.
Does the smoke-free generation law apply to vapes?
No. The rule that stops anyone born on or after 1 January 2009 from buying tobacco applies to tobacco products, herbal smoking products and cigarette papers from 1 January 2027. Vapes and nicotine pouches remain available to adults aged 18 and over.
Are vape flavours being banned?
Not at present. The Act gives ministers powers to restrict flavours, packaging and display, and a consultation closed on 2 October 2026, but no regulations have been made. Any future rules would need further legislation and a start date.
When does the vape advertising ban start?
The government intends the advertising and sponsorship ban for vapes and nicotine products to take effect across the UK from 1 June 2027. The secondary legislation is still being prepared, so that date is a target and could move.
Can vape shops still offer discounts?
Yes. Ordinary discounts, clearance prices and bulk pricing are allowed. What is banned is giving products away free, or selling them at a nominal price such as 10p, where the purpose or effect is to promote them.
Has the 2ml tank limit changed?
No. Nicotine-containing tanks and pods remain limited to 2ml, nicotine refill bottles to 10ml, and nicotine strength to 20mg/ml. These limits come from the Tobacco and Related Products Regulations 2016, not from the new Act.
Final Verdict
The Tobacco and Vapes Act 2026 does not stop adults buying legal vapes, e-liquids or pouches, but it does tighten the rules around them. Since 29 October 2026 the age of sale is 18 for every vaping and nicotine product, including nicotine-free vapes and pouches, adults can be penalised for buying on behalf of under-18s, and free samples are gone. The tobacco smoke-free generation starts on 1 January 2027 and does not apply to vapes. The bigger changes for how vapes are presented, including the advertising ban intended for June 2027 and possible flavour and packaging rules, are still on the way.
